    1. This “Go Aqaba” website is owned & operated by “Al Wjhah Al Jdaydah Aqaba Tourism & Travel” (“Aqaba New Destination Travel”, ‘’we’’, ‘’us’’, ‘’our’’) – a company registered in Aqaba Special Economic Zone Authority under National ID № 100391065 which trades under brand names “Aqaba New Destination Travel” & “Go Aqaba Travel & Tourism”.

    We are member of IATA under the № 40217041, Jordan Tourism Board, Jordan Inbound Tour Operators Association & Adventure Trade Association

    This Policy defines the procedure for processing and protecting Travel Agencies of Go Aqaba Travel & Tourism and its affiliates information about individuals (hereinafter referred to as Users) that can be obtained by us when the User uses the services provided through the site, services, travel agency programs (hereinafter referred to as the Site, Services).

    1. The purpose of this Policy is to ensure adequate protection of information about Users, including their personal data, from unauthorized access and disclosure.
    2. Relations associated to the collection, storage, distribution and protection of information provided by the User are governed by this Policy, other official documents of the Aqaba New Destination Travel and the current legislation of Hashemite Kingdom of Jordan.
    3. RIGHTS AND OBLIGATIONS OF THE PARTIES

    4.1. The site administration has the right:

    4.1.1. Change the rules for using the Site, as well as change the content of this Site. Changes come into force from the moment the new version of the Agreement is published on the Site.

    4.2. The user has the right to:

    4.2.1. Use all the services available on the Site, as well as purchase any Goods and / or Services offered on the Site.

    4.2.2. Ask any questions related to the services of the site

    4.2.3. Use the Site solely for the purposes and procedure provided for by the Agreement and not prohibited by the legislation of Hashemite Kingdom of Jordan.

    4.2.4. Copying information from the Site is permitted with an indication of the source.

    4.2.5. Require the administration to hide any user information.

    4.2.6. Use the site information for personal non-commercial purposes.

    4.3. The user of the Site agrees:

    4.3.1. Provide at the request of the Site Administration additional information that is directly related to the services provided on this Site.

    4.3.2. Comply with property and non-property rights of authors and other copyright holders when using the Site.

    4.3.3. Do not take actions that may be considered as violating the normal operation of the Site.

    4.3.4. Do not disseminate using the Site any confidential and protected by the legislation of Hashemite Kingdom of Jordan information about individuals or legal entities.

    4.3.5. Avoid any actions that may result in the violation of the confidentiality of information protected by the legislation of the Hashemite Kingdom of Jordan.

    4.3.6. Do not use the Site to disseminate advertising information, except with the consent of the Site Administration.

     

    4.3.7. Do not use services to:

    4.3.7.1. violation of the rights of minors (under 18 years old) and (or) harm to them in any form.

    4.3.7.2. infringement of the rights of minorities.

    4.3.7.3. Presenting yourself for another person or representative of an organization and (or) community without sufficient rights, including for employees of this site.

    4.3.7.4. misleading regarding the properties and characteristics of any Goods and / or services posted on the Site.

    4.3.7.5. incorrect comparison of the Goods and / or Services, as well as the formation of a negative attitude towards persons (not) using certain Goods and / or services, or the conviction of such persons.

    4.3.8. Ensure the accuracy of the information provided

    4.3.9. Ensure the safety of personal data from access by third parties.

     

    4.4. The user is prohibited from:

    4.4.1. Use any devices, programs, procedures, algorithms and methods, automatic devices or equivalent manual processes to access, acquire, copy or track the content of the Site.

    4.4.2. Disrupt the proper functioning of the Site.

    4.4.3. By any means bypass the navigation structure of the Site to obtain or attempt to obtain any information, documents or materials by any means that are not specifically provided by the services of this Site.

    4.4.4. Unauthorized access to the functions of the Site, any other systems or networks related to this Site, as well as to any services offered on the Site.

    4.4.4. Violate the security system or authentication on the Site or on any network related to the Site.

    4.4.5. Perform a reverse search, track or try to track any information about any other User of the Site.

    4.4.6. Use the Site and its Content for any purposes prohibited by the legislation of Hashemite Kingdom of Jordan, as well as incite to any illegal activity or other activity that violates the rights of the Site or other persons.

     

    5.0 USE OF THE SITE

    5.1. The Site and the Content included in the Site are owned and operated by the Site Administration.

    5.2. The content of the Site is protected by copyright, trademark law, and other intellectual property rights and unfair competition laws.

    5.3. This Agreement applies to all additional terms and conditions on the purchase of the Goods and / or the provision of services provided on the Site.

    5.4. The information posted on the Site should not be construed as a change to this Agreement.

    5.5. The site administration has the right at any time without notice to the User to make changes to the list of Goods and services offered on the Site and (or) their prices.

     

     

     

    1. RESPONSIBILITY

    6.1. Any losses that the User may suffer in the event of intentional or reckless violation of any provision of this Agreement, as well as due to unauthorized access to the communications of another User, are not reimbursed by the Site Administration.

    6.2. The site administration is not responsible for:

    6.2.1. Delays or malfunctions in the process of the operation occurring due to force majeure, as well as any case of malfunctions in telecommunication, computer, electrical and other related systems.

    6.2.2. Actions of transfer systems, banks, payment systems and for delays associated with their work.

    6.2.3. The proper functioning of the Site, if the User does not have the necessary technical means for its use, and also does not bear any obligations to provide users with such means.

     

    1. VIOLATION OF THE TERMS AND CONDITIONS OF THE USER AGREEMENT

    7.1. The site administration has the right to disclose information about the User if the current legislation of Hashemite Kingdom of Jordan requires or allows such disclosure.

    7.2. The site administration has the right to terminate and (or) block access to the Site without prior notice to the User if the User has violated this Agreement or the terms of use of the Site contained in other documents, as well as in case of termination of the Site or due to a technical problem.

    7.3. The site administration is not responsible to the User or third parties for terminating access to the Site in case the User violates any provision of this Agreement or other document containing the conditions for using the Site.

    7.4. The site administration has the right to disclose any information collected about the User of this Site, if the disclosure is necessary in connection with an investigation or complaint regarding the misuse of the Site or to establish (identify) the User who may violate or interfere with the rights of the Site Administration or the rights of other Site Users.

    7.5. The site administration has the right to disclose any information about the User that it considers necessary to comply with the provisions of the current legislation or court decisions, ensure compliance with the terms of this Agreement, protect the rights or security of the organization, Users.

     

    1. SETTLEMENT OF DISPUTES

    8.1. In the event of any disagreement or disputes between the Parties to this Agreement, a prerequisite before applying to the court is the presentation of a claim (a written proposal for the voluntary settlement of the dispute).

    8.2. The recipient of the claim, within 30 calendar days from the date of its receipt, shall notify the claimant in writing of the results of the consideration of the claim.

    8.3. If it is not possible to resolve the dispute on a voluntary basis, any of the Parties has the right to apply to the court for the protection of their rights that are granted to them by the current legislation of the Russian Federation.

    8.4. Any claim regarding the conditions of use of the Site must be brought within 5 days after the grounds for the claim arise, with the exception of copyright protection for the materials of the Site protected in accordance with the law. In case of violation of the terms of this paragraph, any claim shall be left by the court without consideration.

     

     

     

     

    9.0 Online Payment Security

    The security of processing Internet payments is guaranteed by Bank Of Jordan (?). All operations with online payment cards take place in accordance with the requirements of VISA International, MasterCard. When transmitting information, special security technologies for online card payments are used, data processing is carried out on a secure high-tech server of the processing company. In cases of using regular payments, during the first transaction, your card number and validity period will be stored on the Bank’s side in a safe depository. Upon the performance or provision of services by the company, the data will be deleted automatically. All resources of the Bank comply with PCI DSS security standards.

    During the operation, you will be additionally redirected to the page of the Issuing Bank to enter a confirmation security code (in case the bank that issued your card supports 3DSecure technology, and your card also supports this program).

    3D Secure is an additional cardholder authentication procedure designed to ensure guaranteed security of bank card payments on the Internet.

    3DSecure technological solution has its own brand in each of the payment systems:

    VerifiedbyVisa– by VisaInt payment system cards.

    MasterCardSecureCode– for cards issued as part of MasterCardInt

    Regardless of the name, 3DSecure technology provides a secure session when conducting an Internet transaction and allows cardholders to confirm the legality of the operation for the Bank that issued the card.

    10.0 Cancellation Policy

    Payment for the tour is a fundamental part of the tour’s income and contributes to the overall cost of equipment, running costs, staffing, administration, etc. As the Company will have incurred the majority of its costs before the tour starts, we need to impose cancellation charges to cover these costs.

    Deposits are non-refundable. If you cancel your booking, we will impose cancellation charges as follows:

    30 days or more prior to departure – loss of deposit;

    15-29 days before departure – 30% of tour cost;

    7-14 days before departure – 50% of tour cost;

    6 or fewer days before departure – 80% of tour cost or deposit if greater.

    Tailor-made tours may be subject to alternative cancellation terms, which will be communicated to applicable Clients at the time of booking.

    All cancellations must be in writing and be made by the person who submitted the booking form. Please send an email to your contact at the Company, with a copy to info@goaqaba.com

    Once the tour has started, no refund for any unused portion or part of the tour or services to be provided will be given. If you want to make any changes to the tour, or depart the tour early, such alteration or departure will be entirely at your own expense and liability. You will also need to communicate in writing to the tour operator your reason for leaving the tour.

    Cancellation by the Company

    We reserve the right to cancel the contract between us for any reason prior to your payment of the full price of the trip. In this case, we will refund in full any amount that you have already paid us. After you have paid in full, we will only cancel the contract if circumstances beyond our control make it unavoidable. Such circumstances include, but are not limited to, civil or political unrest, terrorism, natural disaster, or other force majeure circumstance. In the unlikely event that such circumstances arise, we will contact you immediately and offer you the choice of equivalent services or a full refund of all monies paid. No additional compensation will be paid over and above the total sum received from you.

     

    11.0  ADDITIONAL TERMS

    11.1. The site administration does not accept counter offers from the User regarding changes to this User Agreement.

    11.2. User reviews posted on the Site are not confidential information and can be used by the Site Administration without restrictions
